Fraud, Waste, and Abuse? Linda Smith, Jailer with Marion County Sheriff’s Office Disregards County Attorney’s Directive to Produce Surveillance Camera List, Georgia POST Record Shows She Lacks Proper Training

Julia Pierce | August 27, 2026

On July 24, 2026, I released a publication that indicated that county attorney, Wayne Jernigan, directed the sheriff, Derrell Neal, to compile and prepare a list of surveillance cameras responsive to an Open Records Request, in which I was told was to be sent to Linda Smith.

It has come to light that Linda Smith isn’t even an open records clerk. Niven Posey, who has been responding to a recent open records request for sheriff’s vehicles, has indicated that she [Niven] is the only open records clerk for the county, but that’s for another publication.

In this publication, I am asking first, why was I told that Linda Smith was the open records clerk and directed to send my initial open records request to her, if she isn’t an open records clerk at all?

I am then asking if it is fraud, waste, and abuse of city taxpayer funds to have charged for documents that Linda was instructed by the county attorney to produce and indicated that she had those documents ready according to the instruction by the attorney, yet produced a letter that gave exemptions for NOT producing what a city taxpayer provided the money to produce.

Linda Smith, disobeyed a legal directive, misrepresented by her own hand what I had paid to receive, and used legally authority that does not excuse her from an alleged violation of the Georgia Open Records Request.

A greater question should be, if sheriff Derrell Neal had given his word that he and his office would comply with the county attorney’s directives and why did Linda Smith choose to do what was in direct contradiction of legal advice and the law? Is she in violation of the law for theft by deception, fraud, waste, and abuse?

On August 1, 2026, I performed an open records request with Georgia Post for Linda Smith’s POST record, which shows her employment, previous and current, her training, and any rewards or disciplinary action. Linda’s POST record shows she is a jailer and jail training officer. In fact, I think it would be a good suggestion if Linda took some training on the Open Records Act. Pay attention that she has no firearms training at all! She has no training in deadly force, no training in de-escalation, no training in Human Trafficking, and only 1 hour of community policing and gang awareness, yet she is a jailer for the Marion County jail, dealing with criminals. How does she plan on protecting herself, the jail inmates, or the community members she swore to protect and serve?

On a completely unrelated topic, I find it’s interesting that Linda has taken courses on how to deal with the mentally ill, elder abuse, and all others sorts of Americans with Disabilities, but I digress.

Stay tuned for the publication that picks up with Niven Posey, another jailer, where Linda Smith left off, to see how I was denied a refund for this open records request, and have alleged theft of my client’s hard-earned money.

What are your thoughts? Do you think that Linda Smith can be an effective jailer with no training? Do you consider what Linda has done fraud, waste, abuse, theft?
